Viagra’s Manufacturer’s BeneficiariesPlaintiffs alleged that in November 1999, the pharmaceutical industry notified the federal agency that it was requiring Medicare patients who had been prescribed Viagra to enroll in Medicare-sponsored health plans (HSP). The HSP required that Medicare beneficiaries be provided with a list of drugs to be prescribed, including generics, which they would be required to take for as long as necessary to keep the costs of treating erectile dysfunction from being passed on to their doctors.

The manufacturer's claim was that the drug's side effects were "significantly greater than the potential side effects" of Viagra, although it did not identify any serious side effects of the drug or any potential problems with its safety.

Dosage and QuantityPlaintiffs argued that the FDA had prescribed the drug based on the information they had received about the side effects of the drug's use. The FDA declined to issue a regulation that would require the manufacturer to provide an increase in the dosage of a drug's active ingredient, but said that a drug's cost and quality were generally of a high standard and that a drug's safety and efficacy were "always the same" and that the drug's benefits and the cost of the drug were "generally accepted" as of the date of the drug's introduction.
